Terms of Service

1. Service Description

OccluTrace (“the Service”) is a web-based platform that provides AI-powered dental occlusion alignment. Users upload upper and lower jaw STL scan files, and the Service processes them to compute corrected occlusal alignment and generate contact visualizations.

2. Acceptance of Terms

By accessing or using OccluTrace, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. We reserve the right to modify these terms at any time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

3. Accounts

Access to OccluTrace requires authentication via Google OAuth or email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information during registration and promptly update any changes. You may not share your account with others or allow third parties to access the Service through your credentials.

4. Free Tier and Credits

New accounts receive complimentary scan credits upon registration. Each credit allows processing of one pair of STL files (upper and lower jaw). Additional credits may be purchased or made available through promotional offers. Unused credits do not expire unless the account is terminated or suspended for violation of these Terms. We reserve the right to modify pricing, credit allocations, and the free tier at any time with reasonable notice to existing users.

5. Acceptable Use

OccluTrace is intended for use by licensed dental professionals, dental laboratories, and CAD/CAM technicians. The Service is not intended for direct patient diagnosis or treatment planning. You agree not to:

  • Use the Service for any unlawful purpose
  • Upload files containing malware, malicious code, or patient-identifiable information beyond what is necessary to perform the Service
  • Attempt to reverse-engineer, decompile, or extract the AI models or algorithms
  • Resell, sublicense, or provide access to the Service to third parties without written authorization
  • Use the Service output as the sole basis for clinical decisions without independent professional review and verification
  • Upload data for which you do not have lawful authority to process

6. Intellectual Property

Your content: You retain all rights to the STL files and dental data you upload. By uploading, you grant OccluTrace a limited, non-exclusive license to process, store, and transmit the files solely as necessary to provide the Service. We do not claim ownership of your scan data.

Our technology: The AI models, software, algorithms, and visual design of the Service are proprietary to Dental Cloud Technologies LLC and its licensors. Nothing in these Terms transfers any intellectual property rights to you. You may not copy, modify, or create derivative works based on the Service.

7. Medical Device Disclaimer

OccluTrace is NOT a medical device and is not approved, cleared, or registered by the FDA, CE, or any other regulatory body. The Service provides computational analysis for professional reference only. All clinical decisions remain the sole responsibility of the treating dental professional. Output from OccluTrace must be independently verified by qualified personnel before use in any clinical application. Do not use Service output as a substitute for professional clinical judgment.

8. Data Handling

Uploaded STL files are stored securely on our servers and are used solely to provide the Service. Files are retained until you delete them or your account is terminated. We do not share your scan data with third parties except as necessary to operate the Service (e.g., cloud infrastructure providers under confidentiality agreements) or as required by law. 9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED. AI-assisted occlusal analysis is inherently probabilistic; results may vary based on scan quality, anatomy, and clinical conditions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DENTAL CLOUD TECHNOLOGIES LLC AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO CLINICAL OUTCOMES, LOSS OF DATA, OR LOSS OF REVENUE. Our total aggregate liability for any claim arising under these Terms shall not exceed the total amount you paid for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dental Cloud Technologies LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any clinical decisions made based on Service output.

12. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in settings. We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity. Upon termination, your right to use the Service ceases immediately. Uploaded data will be deleted within 30 days of termination unless retention is required by applicable law. Sections 6, 7, 9, 10, 11, and 13 survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in Florida. OccluTrace is a service of Dental Cloud Technologies LLC, a Florida limited liability company.
